Terms of Service

1. Acceptance of Terms

By accessing or using Plusinv (“the Platform”), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services. These terms apply to all users including business owners (Tenants) and their customers.

2. Description of Service

Plusinv is a multi-tenant Software-as-a-Service (SaaS) platform that enables Philippine equipment rental businesses to manage their operations online. The Platform provides:

• A customizable storefront for rental businesses to list their equipment
• Booking management tools for rental operators
• Payment processing through PayMongo for Philippine payment methods
• Customer management and communication tools

3. Account Registration

For Business Owners (Tenants): You must register and await manual approval by Plusinv administrators before your storefront goes live. You are responsible for providing accurate business information. Each approved tenant receives a unique subdomain (e.g., yourbusiness.plusinv.online).

For Customers: Customers must create an account and verify their email address before placing bookings. Customer accounts are scoped to individual tenant storefronts.

4. Booking Policy

All bookings made through the Platform are subject to the following rules:

• No Cancellation by Customers: Once a booking is submitted and accepted, it is binding. Customers may not cancel bookings through the Platform.
• No Refund Policy: Payments processed through the Platform are non-refundable. Any refund arrangements must be made directly between the customer and the rental business operator.
• Tenant Cancellations: Rental businesses may cancel bookings at their discretion (e.g., equipment unavailability). Such cancellations are handled directly between the tenant and customer.
• Deposit Requirements: Some rental businesses may require a deposit. Deposit terms are set by the individual rental business.

5. Payments

Payment processing is handled through PayMongo, a third-party payment processor. By making a payment, you also agree to PayMongo's terms of service. Plusinv supports GCash, Maya, credit/debit cards, and bank transfers for Philippine customers.

Rental businesses are responsible for their own payment configurations. Plusinv does not store complete payment card details on our servers.

6. Tenant Responsibilities

As a registered tenant on Plusinv, you agree to:

• Provide accurate and up-to-date information about your equipment and services
• Honor confirmed bookings to the best of your ability
• Comply with all applicable Philippine laws and regulations
• Maintain appropriate business permits and licenses as required by law
• Not use the Platform for fraudulent or illegal activities
• Protect customer data in accordance with the Data Privacy Act of 2012 (Republic Act 10173)

7. Prohibited Activities

Users must not:

• Use the Platform to conduct illegal activities
• Attempt to gain unauthorized access to other accounts or systems
• Upload malicious code, spam, or disruptive content
• Misrepresent the nature of listed equipment or services
• Circumvent or attempt to circumvent the Platform's security measures

8. Intellectual Property

The Plusinv platform, including its design, code, and brand, is owned by Plusinv and protected by copyright and other intellectual property laws. Tenants retain ownership of their own content (equipment listings, images, descriptions) uploaded to the Platform.

9. Limitation of Liability

Plusinv is a technology platform that facilitates connections between rental businesses and customers. We are not a party to any rental agreement between tenants and their customers. Plusinv shall not be liable for:

• Disputes between tenants and their customers
• Loss or damage to rented equipment
• Business losses resulting from Platform downtime
• Any indirect, incidental, or consequential damages

10. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access to the Platform. We reserve the right to suspend or terminate accounts that violate these terms, or to modify, suspend, or discontinue the service with reasonable notice.

11. Governing Law

These Terms of Service are governed by the laws of the Republic of the Philippines. Any disputes shall be resolved in the appropriate courts of the Philippines.

12. Changes to Terms

We reserve the right to modify these terms at any time. We will notify registered users of significant changes via email. Continued use of the Platform after changes constitutes acceptance of the updated terms.
